I am positively IRATE!! {fire}

As I have mentioned before, in past posts, My hubby and I are very serious diecast collectors'...Most of what we buy we buy online....prolly about 80% of our cars are from ebay and online private diecast stores and outlets. And always the same dealers...Well...
On Sunday the 18th, directly after the Daytona 500, I went online to a diecast site called *&%$#@'s World censored to be fair to buy a diecast replica of Michael Waltrip's <-----the winner car for our collection. We did find it and bought it on the spot. We used our credit card as always with this particular store...and paid $52.50 for the car. We received a letter of confirmation from the owner...I have posted it here:
Dear Robert,

So......
A few hours later we learned of Mr. Earnhardt's death and went online to check out what had happened. Hubby suggested we go on ebay for a moment....He wanted to see how crazy people were getting over his merchandise....Well, as it turns out, in only about two hours the price of his diecast cars went from between an average of $50.00-$60.00 each...to between $400.00-$500.00 each...a few even sold for $900.00!!! We were shocked! and glad we already have all of his cars!
Anyhow, the next morning we received a letter from the guy we bought the Michael Waltrip car from on the 18th...Here is the letter he sent me: edited of course for fairness

Dear Customer,

I am very sorry to have to inform you we will be unable to fulfill your order off our StoreFront. Please be aware that all of the product was sold out before your order was accepted into the system. It is unfortuante what has happened and we are all deeply saddened by the passing of the "Great #3". We have worked steadily to try & replace Dale Earnhardt Sr. cars a to meet the demands of our customers and have been able to locate a few pieces, but the pricing has increased quite dramatically. Please accept our sincere apology and we do hope to be able to do business with you in the future.....

Now....did you notice how it went from 'Dear Robert'....to 'Dear Customer'...?!?! We have been dealing with this distributor for two years! Exclusively!! You have no idea how much money he has made off of my husband and I.
anyhow...I went back to his site directly after reading this letter from him and He did not sell out!!!! What he did do, was jack the price up to $75.00!!!! from 45.00+shipping...to 75.00 +shipping! That is why he cancelled our order.....because he wants the 30.00 extra dollars for it.
My hubby is soooooo angry now!
It truly amazes me to see how greedy people can get when it comes to a tragedy such as this...Those trueblue, so-called, #1 fans of D.E. got to seeing green before the poor man was even pronounced dead for crying out loud!

Hubby has tried to reach him on the phone and he will not answer our calls or messages. Hubby is even considering taking him to court because now there is a very good chance we will never get another one.
Tell me what you would do?

I'd be {flame} 'n mad!!! Is it worth taking him to court?? Is there like a BBB of the ebay you can report him to???

It's such a shame that people have to get greedy like that. Karen, I would ask a lawyer or someone with that knowhow to see what you can do. 4gvnangel has a good point about a better business bureau. I hope you can get this worked out. Good luck.

That is just wrong.
Don't get rid of anything he sent you that is for sure.

thanks guys.....By the advice of a good friend ;) I checked my credit card account to see if maybe he charged me for it and then put it back when he took back the car.....But alas, he did not. {bawling}
It would have been real easy to get him in court if he had charged me...oh well.
BBB here I come!

BTW TTP, I kept everything!
I have all these letters in my virtual filing cabinet and my real filing cabinet.

Most online auction sites DO have a way to file a complaint about things like that... I do not know how to do it though.
And this guy is a jerk!!!
